GENERAL SAFETY/HAZARD AGREEMENT
Weisiger Group Inc., Carolina 1926 LLC d/b/a Carolina Cat, LiftOne LLC, and their subsidiaries and affiliates {hereafter, “Weisiger Group”), Is committed to the safety and wellbeing of its employees, contractors, vendors, suppliers, visitors, and community. Entry into the Weisiger Group facility (the "Facility") by the undersigned (the “Visitor(s)”) providing Goods, Services, or Transport is conditioned upon and permitted in consideration for Visitor reading, signing, and abiding by the terms and conditions of this General Safety/Hazard Agreement (the “Agreement”). Failure to do so may result in a denial or revocation of access to the Facility.
GENERAL SAFETY RULES
EMERGENCY PROCEDURES
Reporting Emergencies: In case of a fire, explosion, release of harmful substances, or other emergencies, immediately inform the nearest Weisiger Group employee.
Emergency Signal: Adhere to all emergency loudspeaker announcements or signals and follow the instructions of the Weisiger Group employees.
Emergency Evacuation: If instructed to do so, Visitor shall report to designated gathering places. Visitor is to remain with his Weisiger Group employee escort and report to such escort's designated gathering place.
Medical Assistance: Inform the nearest Weisiger Group employee if medical assistance is needed.
Report all accidents and near misses to Weisiger Group HR.
Report all chemical spills or releases of hazardous materials immediately to Weisiger Group HR.
REQUIRED PRACTICES
Use extreme caution around operating equipment, moving materials, and moving vehicles.
Spills from transport vehicles are the transporter's responsibility and must be addressed to Weisiger Group's satisfaction. Spills of hazardous materials, whether at or away from the Facility, must be reported to Weisiger Group's HR if the hazardous material was generated at the Facility.
No tanks may be brought to the Facility without prior permission from Weisiger Group's HR.
Non-hazardous solid waste must be disposed of in designated on-site containers.
Hazardous waste generated at the facility must be immediately reported to Weisiger Group's HR for proper disposal.
Visitor must comply with posted signs including No Smoking, Do Not Enter, Speed Limit, traffic signals, and road signs. Fork trucks and heavy equipment always have the right of way.
Welding and similar activities require pre-approval by an authorized Weisiger Group employee.
All chemical containers must be properly labeled and have a SDS on file with Weisiger Group's HR.
RELEASE OF LIABILITY AND CONFIDENTIALITY
Visitor acknowledges that the processes at the Facility are or may be in continuous operation and that there is a danger to each person (including Visitor] of property damage and/or personal injury.
Visitor assumes all risks of property damage and/or personal injury, including death, which Visitor may cause or incur as a result of being at the Facility. Visitor hereby releases Weisiger Group and its respective employees from any and all liability from any damage, injury and/or death and agrees and covenants on behalf of Visitor, and Visitor's heirs and/or assigns, not to sue or make any claim against Weisiger Group or any of its respective employees for any such damage, injury, or death.
Visitor acknowledges that, except for information and materials that are (a) generally available to the public through no fault of Visitor, (b) already known by Visitor as shown by documentary evidence, (c) subsequently disclosed to Visitor by someone not under an obligation of confidentiality to Weisiger Group, or (d) independently developed without using information from Weisiger Group, all information and materials viewed or made available at the Facility that relate to Weisiger Group's manufacturing processes, products, plant layout, plant operations, data, machine designs, and customers are owned by Weisiger Group, are confidential to Weisiger Group, are trade secrets of Weisiger Group, are disclosed In strictest confidence, and may not be disclosed to any third party. No person shall disclose, use, copy, photograph, record, or disclose any such confidential information or trade secrets without express written permission from Weisiger Group.
INSURANCE
Visitor shall maintain such insurance that includes Commercial General Liability and Automobile Liability for damages or injury caused by Visitor’s negligence. Visitor will carry Workers’ Compensation coverage that provides a waiver of subrogation in favor of Weisiger Group.
INSURANCE AND INDEMNIFICATION TERMS FOR services
INSURANCE
The Insurance Service Provider (“Service Provider”) shall carry, at its own expense, in insurance companies admitted in the State of Operations, Best rating of A- VII or higher, and satisfactory to Weisiger Group the following types of insurance coverage with limits not less than those shown on the respective items below. Service Provider acknowledges that such minimum insurance requirements do not limit the liability assumed by Service Provider.

Service Provider shall furnish Weisiger Group, an ACORD Certificate of Insurance as evidence of coverage prior to beginning work and on renewal.
Additional insured on Commercial General Liability (including Products & Completed Operations) and Automobile Liability in favor of Weisiger Group.
Waiver of subrogation endorsement on Workers' Compensation, Commercial General Liability, and Automobile Liability in favor of Weisiger Group.
All policies providing insurance coverage shall contain provisions that no cancellation in the policies shall become effective except with thirty (30) days written notice thereof to Weisiger Group.
Property Insurance will be provided by the Service Provider for the value of all owned and/or rented/leased/borrowed tools and equipment in the event of loss or damage and include a waiver of subrogation in favor of Weisiger Group.
Service Provider's insurance shall be primary and not in excess of or contributory with any insurance policies held by Weisiger Group.
Weisiger Group reserves the right to request additional insurance limits, policies, or endorsements.
INDEMNIFICATION
To the fullest extent permitted by law, the Service Provider shall defend, indemnify and hold harmless Weisiger Group, its subsidiaries and affiliates and their employees, directors agents, and officers from and against all claims, damages, losses, and expenses, whether based on contract, tort (including negligence and strict liability), or otherwise related to this Agreement, including but not limited to attorneys' fees, arising out of or resulting from performance of Service Provider's Operations, Work or Products provided that such claim, damage, loss, or expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property including loss of use resulting therefrom, but only to the extent caused by negligent acts or omissions of the Service Provider, anyone directly or indirectly employed by them, or anyone for whose acts they may be liable. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of indemnity which would otherwise exist as to a party or person described in this paragraph.
